LIMITED WARRANTY STATEMENT - AMERICAN MICRO INC.

Hardware Products Covered and Duration of Warranty

This Limited Warranty applies in the United States and Canada to computer Hardware Products and Software Products sold by American Micro Inc.

American Micro Inc.'s obligations with respect to software distributed with a system, or sold separately, are set forth in the applicable end user license agreements(s), provided by the respective software manufacturers. American Micro Inc., has no other obligation to repair or replace software under this limited warranty. Non-manufacturer hardware and software products are provided on an "AS IS" basis, however, manufacturers, suppliers, or publishers may provide their own warranties.

The warranty does not cover any expendable parts, including but not limited to media used in floppy drives, zip drives, CD-ROM drives, DVD drives and tape drives. This warranty does not cover any 3rd party products not purchased from American Micro Inc., including any damage to the American Micro Inc., products and equipment that may occur as a result of the installation, damage or failure of such 3rd party products.

Year 2000 roll over issues are limited to American Micro Inc.'s assurance that all systems sold after July 1, 1997 will not exhibit a hardware BIOS rollover problem. All other year 2000 issues of any kind or nature, including but not limited to software, data, data sharing, are expressly excluded from this limited warranty and no liability by American Micro Inc., is assumed hereby.

Terms of the Warranty

American Micro Inc., warrants that the hardware product you have purchased is free from defects in materials or workmanship under normal use during the warranty period. The warranty period commences on the date of purchase, being that date shown as "Invoice Date" on the original invoice. The warranty extends only to the original purchaser, as shown on said original invoice. It is not transferable to any subsequent purchaser.

During the warranty period, American Micro Inc. will, at no additional charge F.O.B. any American Micro Inc., store or authorized repair facility, repair or replace defective parts with new parts or, at the option of American Micro Inc., repair or replace defective parts with serviceable used parts that are equivalent or superior to the new parts in performance. All exchanged parts and products replaced under this warranty will become the property of American Micro Inc.

This Limited Warranty also does not cover any product that has been damaged or rendered defective (a) as a result of accident, misuse, or abuse, (b) as a result of an act of God, (c) by operation outside the usage parameters stated in the product's "User's Guide", (d) by the use of parts not manufactured or sold by the manufacturer, (e) by modification of the product, or (f) as a result of service by anyone other than American Micro Inc., or an American Micro Inc, authorized repair provider. American Micro Inc., is not responsible for damage to or loss of any programs, data, or removable storage media.

All limited warranty repair & service work will be done off-site at any American Micro Inc., store or authorized repair facility, unless customer has purchased a separate "On-Site" service agreement, as would be shown on any original invoice as a separate line item. In such case said on-site warranty will in no way work to expand the terms of the limited warranty, except only to the extent that the repair or replacement of parts, as provided for herein, may take place at the customers location instead of an American Micro Inc., store or authorized repair facility.

Third Party On-Site Support

American Micro Inc., may from time to time use third party companies, their personnel or other contractual personnel to provide authorized on-site service and authorized telephone technical support.

EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY AMERICAN MICRO INC., MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AMERICAN MICRO INC., EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS LIMITED WARRANTY. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW ARE LIMITED TO THE TERM OF THIS EXPRESS LIMITED WARRANTY.

"Notebook Total Care Upgrade" Warranty

American Micro Inc. (AMI), covers the purchased notebook computer for a period of 3 years from the date of purchase for all hardware failures regardless of any underlying manufacturer warranty, except this warranty does not cover notebook batteries.  AMI at its sole discretion may choose to replace a defective notebook if same cannot be repaired.  If replaced, it will be with a unit of similar age and specifications, or a new unit with similar specifications.  AMI pays the freight to and from customer's location, or such other destination as we require, which may include the manufacturer's repair facilities.  This coverage is limited to accidental damage to the notebook, and not willful acts.  Coverage extends only as to the hardware, and AMI will not be responsible for any loss of customer data, customer software, and/or any loses due to uses to which the notebook computer may be put.

To facilitate this warranty upgrade through AMI customer agrees to and requests that the notebook be registered with the manufacturer in the name of American Micro Inc., and/or Phil Jordan, President of American Micro Inc.  After the "Notebook Total Care Upgrade" expires customer may request that AMI contact the manufacturer and request the registration be transferred.

 FAQ:

        What are the advantages to buying the Notebook Total Care Upgrade?

Customer  will call AMI for all warranty issues, thus avoiding the long and sometimes complicated process of getting warranty support from the manufacturer.

The notebook is sent from the customer to AMI if in need of warranty repair, and not to the manufacturer, and AMI will in turn send the notebook to the manufacturer, if needed.

        What are issues some might perceive as the disadvantages to buying the Notebook Total Care Upgrade?

 No telephone, or hardware support, will be available from the manufacturer direct to the customer, therefore customer is required to contact AMI for all services.

  AMI's office hours, and telephone support hours, are 9:00AM to 5:00PM, Monday thru Thursday Eastern time, excluding holidays.
